All orders placed on the web site www.smoke-nut.com are considered as binding purchase agreement between buyer and seller where the seller is a company Bongin s.r.o.. The buyer is obliged to fill in your details correctly and according to the facts, or the purchase contract void.

By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time. It is your responsibility to check these terms and conditions regularly before ordering products.
Orders
All orders are subjected to acceptance and product availability. Pricing of products is correct at the time of entering information, however, we reserve the right to change prices without prior notice.
Availability of goods
Availability information is listed next to each individual product. Items which are in stock at the time of order, are usually despatched within 1 day, except holidays. Items in preorder - like customized pipes and bongs, are dispatched usually in 3 days - 7days at maximum. If items are not available for your order, Smoke-nut.com will inform you by e-mail at your e-mail address given in your order form and offer replacement or other solution.
Your undertakings and warranties
You warrant that all informations provided by you are complete and accurate.
Acknowledgement of order
Once you complete your order you will be sent an e-mail confirming your order. It will state what the products are, the cost (including VAT and P&P) and delivery and invoice details. If your order has been unsuccessful, you will receive an e-mail with all possible reasons.
Payment
All credit card holders are subjected to validation and authorisation by the card issuer. If the issuer of your credit card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
Returns
Your statutory rights as a consumer won't be affected if, for any reason, you wish to return a product bought from Smoke-Nut shop. If you cancel the contract, we will refund you the full price of goods you return, after we receive it back. Shipping charge won't be refunded. Customized products can not be returned. Be aware that you can return only unused items.
Delivery
Delivery terms and conditions full comply with terms and conditions for package delivering of used service. Bongin s.r.o. can use any service that are suitable to deliver ordered goods to provided address. Delivery times stated on the order checkout page are only informative and we are not responsible for any delays, as we do not provide delivery services ourselves. Bongin s.r.o. shall have no liability for delay or any failure to deliver goods to you which is caused by an event or circumstances beyond its reasonable control.
Limitation of liability
Subject to any relevant consumer protection legislation including our obligation under the Consumer Protection (Distance Selling Regulations) to give you full refund, if you cancel your contract /before your order is sent/ or if your package is not delivered within 90 days since the posting date. Your order can also be reshipped instead of the refund. Our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.
Policy of damaged items caused during shipment
In case of receiving a damaged product all you need to do is send us a clear proper picture of the broken unused item within seven days from the delivery. Later complaints won't be accepted.
Customs service
Please, be aware that we are not responsible if the package is hold or seized by custom officers in the case our products are sent to countries, where these goods are prohibited. Even though we sell only tobacco products, some countries might consider them as drug products. If the customs service requires to pay custom fee, all these expenses are paid by customers.

The Bongin s.r.o. places great importance on maintaining the security of all information that you provide and for this reason we use advanced Internet security system to safeguard your data. All data you send through including your credit/debit card number, name and address are encrypted and converted into a code before it is transmitted across the Internet. Therefore in the extremely unlikely event that the data should be intercepted it would be encrypted and difficult to decipher.
Invalidity of terms and conditions
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
Governing law and jurisdiction
Contracts between you and Smoke-Nut.com shall be governed by Czech Law and you and Bongin s.r.o. submit to the exclusive jurisdiction of the Czech courts.
Pursuant to the Act on Registration of Sales, the salesperson is obliged to issue a receipt to the buyer. Sales must be registered to the tax authority online; in case of a technical failure this must be done within 48 hours.
